First we need to determine what your particular situation is - Recovery or Repossession

Repossession - California state law defines repossession as a defaulted contract for payment, holding the vehicle as collateral. This contract must include a repossession clause; a repossession clause would be a paragraph that goes something like this: "If buyer defaults in this contract the collateral may be repossessed and all repossession fees, attorney and court cost will be the responsibility of the debtor" If your written contract has the repossession clause we could legally repossess the vehicle on your behalf. Recovery - May be just a verbal agreement between two parties or just your basic promissory note with an agreement to pay, with no repossession clause as stated above.
